Consensual sex between two adults has always been 100% legal, except under 2 conditions.
# 1) Promise of marriage. Man has sex with woman after promising to marry her.
# 2) Adultery. Man has consensual sexual intercourse with a married woman.
Well, # 2 is no longer valid 👍 Adultery was punishable earlier, as per Section 497 of the Indian Penal Code (only the man having the affair with the married woman was punishable, never the married woman), but not anymore. On 27 September 2018, the Supreme Court’s five-judge Constitution bench unanimously ruled to revoke Section 497 and that is no longer a crime in India. It’s no longer a crime in India to have a sexual relationship with a married woman
